At a murder trial the evidence at the close of the Commonwealth's case-in-chief and at the close of all the evidence was sufficient to submit to the jury, and the Judge properly denied the defendant's two motions for required findings of not guilty. [173-175] In the circumstances of the evidence at a murder trial, the Judge did not err in refusing to give a specific requested instruction that inferences favorable to the defendant might be drawn from the Commonwealth's failure to conduct certain forensic tests, where the Judge gave a general instruction on inferences and where defense counsel was allowed to argue the point to the jury.
