COX, Justice. The defendant was found guilty by a jury upon one count of an indictment which alleged that James M. OBrien on the sixth day of January in the year of our Lord one thousand nine hundred and thirty-five, being an officer of a city, to wit: the treasurer of the city or Revere, a municipal corporation legally established and existing and being duly and legally elected and qualified to perform the duties of such officer, did embezzle and fraudulently convert and did fraudulently take and secrete with intent to embezzle and fraudulently convert, money of the amount and of the value in all of $13,277.04 of the property of the said city of Revere. At the close of the Commonwealths evidence the defendant rested and presented a motion for a directed verdict of not guilty, which was denied subject to his exception.
